Terms of Service (AGB)
§ 1 Scope & Provider
These Terms of Service apply to the use of the application Kalouri (the “App”) and to contracts between you as a consumer or business and ELAG International Group Ltd., Tepeleniou 13, Tepeleniou Court, 2nd Floor, 8010 Paphos, Cyprus (the “Provider”).
§ 2 Description of Services
Kalouri is a web app for tracking calories and macronutrients with a food search (Open Food Facts), optional AI-powered photo estimation and local dishes. All nutritional values are estimates and provided without guarantee; they do not replace medical or dietary advice.
§ 3 Free Use & Premium Subscription
The basic features can be used free of charge. Optionally, a Premium subscription can be purchased: 3,99 € per month or 29,99 € per year. It unlocks all premium features (e.g. unlimited photo recognition, personal app download). The subscription renews for the selected term and can be cancelled at any time with effect from the end of the current term.
Payments are processed by Stripe Payments Europe, Ltd.; its terms apply in addition for the payment process.
§ 4 Conclusion of Contract
By completing the activation process in the app, a contract for the provision of digital content is concluded between you and the Provider.
§ 5 Prices & Payment
The price displayed at the time of ordering applies. For consumers, prices include statutory VAT (currently 19 % Cypriot VAT). Business customers with a valid VAT identification number from an EU member state other than Cyprus are charged the net price; VAT is then owed by the recipient (reverse charge). Payment is made via the payment method offered.
§ 6 Right of Withdrawal
Consumers have a statutory right of withdrawal. Details can be found in our cancellation policy. For digital content, the right of withdrawal may expire early if you have expressly consented to immediate performance and confirmed your knowledge that the right of withdrawal thereby expires.
§ 7 User Obligations
You warrant not to upload any unlawful content and not to misuse the app. In particular, do not upload photos containing personal or sensitive content of third parties.
§ 8 Liability
The Provider is liable without limitation in cases of intent and gross negligence as well as under product liability law. In cases of slight negligence, the Provider is liable only for the breach of an essential contractual obligation and limited to the foreseeable damage typical for this type of contract. No liability is assumed for the accuracy of the estimated values.
§ 9 Changes to these Terms
The Provider may amend these Terms with effect for the future, insofar as this is reasonable.
§ 10 Final Provisions
The law at the Provider’s registered office applies, subject to mandatory consumer protection provisions. Should any provision be invalid, the validity of the remaining provisions remains unaffected.
These Terms do not replace individual legal advice.
